For all orders placed via the Website and for our deliveries and services, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. We do not recognise any deviating terms and conditions of the customer unless we have agreed to their validity in writing.

2. Conclusion of Contract

A contract between you and Furch Gestaltung + Produktion GmbH is only concluded when we send the ordered goods to you. By sending us the order form provided on our website, you submit a binding offer to us to conclude the contract with you. You place the order when you have entered all the details during the ordering process and finally send the order form to us by clicking on the "Order with costs" button. Our offer is aimed exclusively at consumers. According to § 13 of the German Civil Code (BGB), a consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. The services offered by Furch Gestaltung + Produktion GmbH are not available to minors. Furch Gestaltung + Produktion GmbH is entitled to reject an offer from you without stating reasons, in particular if there is reasonable suspicion that the goods purchased via the Internet are to be resold commercially.

 

The language available for the conclusion of the contract is German.

3. Storage of Contract Text

We store your order data. You will receive an order confirmation with all the specified data by e-mail, which can be printed out.

 

4. Right of Revocation

Consumers have a statutory right of cancellation. The relevant instructions and cancellation form as a sample can be found here (Right of Revocation).

 

Please note that we can only accept returns from the respective country of delivery. For example, if the delivery was made to Austria, the return may only be arranged from Austria. Your bank/credit card account will be debited upon conclusion of the contract. In the event of a return, your account/card will be credited; any losses due to currency fluctuations will not be refunded.

 

5. Notes

The goods offered in our online shop are represented in the form of digital photographs of the actual goods. Minor deviations between representation and reality do not constitute a defect in the goods ordered. The goods may deviate in part from the characteristics and may not correspond absolutely with any samples viewed, as a certain tolerance range must be allowed for colours and shades as well as for the material and dimensions. The manufacturer reserves the right to change the technical characteristics of the products at any time and without prior notice. The products presented here may no longer be available or available at the time the customer visits the website. The corresponding prices may have changed. We are authorised to make partial deliveries.

All prices are in EURO and include the statutory German value added tax (VAT). Postage and shipping costs are added according to the following list under 7.

7. Shipping and Delivery

We deliver by dispatch, collection by the customer is possible. We charge shipping costs according to our current price list, see (SHIPPING).

Delivery dates within Germany:

Unless otherwise agreed, delivery shall be made to the delivery address specified by the customer within four working days (Monday to Friday, excluding public holidays) after conclusion of the contract with simultaneous payment.

Delivery Dates within EU (outside Germany):

Please note: Deliveries within the EU are only possible after consultation and submission of an offer by Furch Gestaltung + Produktion GmbH. Delivery to packing stations or post office boxes is unfortunately not possible, thank you for your understanding. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer within five working days (Monday to Friday, excluding public holidays) after conclusion of the contract with simultaneous payment.

 

Delivery dates outside EU:

Please note: Deliveries outside the EU are only possible after consultation with and submission of an offer by Furch Gestaltung + Produktion GmbH. Delivery to packing stations or post office boxes is unfortunately not possible, thank you for your understanding. Experience has shown that the delivery time is two to fourteen working days, so that delivery is made within fourteen working days (Monday to Friday, excluding public holidays) at the latest after conclusion of the contract with simultaneous payment or according to the offer after advance payment. For deliveries to countries outside the EU, additional customs duties and fees are payable by the customer, the amount of which we can neither influence nor predict. You can find out more from your local customs office. Please note that any foreign bank charges are to be borne by you. Customs duties, import sales tax and handling fees will not be refunded in the event of a return. We accept no responsibility for delays in delivery caused by our postal and logistics service providers.

8. Terms of Payment

Before the payment methods available to you are displayed, you will be asked to enter your details (name, address, etc.). The following payment options are available to you:

 

Prepayment by bank transfer

If you select the payment method prepayment, we will provide you with our bank details in the order confirmation and deliver the goods to you after you have paid for the goods in full.

PayPal

You pay the invoice amount via the online provider PayPal. You must always be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us (exception: guest access). You will receive further instructions during the ordering process.

 

The goods will be dispatched after receipt of payment. You must ensure that there are sufficient funds in your account at the time of the direct debit; any costs arising from a chargeback of the invoice amount for which you are responsible shall be borne by you.

 

9. Information on Liability for  Defects

The statutory liability for defects applies.

10.Retention of Title

The delivered goods remain the property of Furch Gestaltung + Produktion GmbH until full payment has been received.

 

11. Guarantee

The statutory warranty law applies.

We do not usually give guarantees. A guarantee regarding the goods delivered by us therefore only exists if this has been expressly given, e.g. in the purchase confirmation for the respective item.

 

Usual or unavoidable material-related deviations in the quality, colour, size, finish and design of the goods are generally insignificant. Warranty claims do not usually arise in this respect. However, you are at liberty to prove that such deviations are significant.
